These General Terms and conditions of Lease form an integral part of the Rental Agreement and are applied to it entirely.

The most important points at a glance.
1.1 Lessor — company Fuerte d.o.o., based in Split, Croatia at the address Obala Lazareta 3, VAT ID: 71550144918.
1.2 Lessee — a natural or legal person who or on whose behalf the vehicle is rented, signs the Rental Agreement on the basis of which he leases the vehicle and is responsible for compliance with all provisions of the General Terms and conditions of Lease as well as the Rental Agreement.
1.3 Driver — a natural person listed in the Rental Agreement as "Driver", signs the Rental Agreement on the basis of which he takes over the vehicle. One or a maximum of three drivers may be listed on the Rental Agreement.
Who can drive the vehicle:
1.4 User documents — When renting a vehicle, the User is obliged to present originals of valid documents (identity card/passport and driver's license).
1.5 Rental Agreement — a contract signed prior to taking over the vehicle, defining the make, model and registration number of the vehicle, date of collection and return, rental price, payment method, additional equipment and services, insurance included in the price, and other rights and obligations.
1.6 Vehicle Condition Report — an internal act of the Lessor containing all relevant information about the vehicle before and after the rental period. The Driver is obliged to sign it before and after the rental.
1.7 Price List — an internal act of the Lessor containing damage charges and fees for all vehicle makes and models.
1.8 Lessee's Statement of Damage — an internal form the Driver is obliged to fill in and sign if during the lease there was a traffic accident or other event resulting in any visible or invisible damage to the vehicle.
1.9 Statement of Consent — a statement signed by the User giving consent to the Lessor to collect and process personal data in accordance with the General Data Protection Regulation.
2.1 After concluding the Rental Agreement, the Lessor undertakes to deliver the vehicle to the User in a technically correct and fully functioning condition with all necessary documentation, accessories and mandatory equipment.
2.2 By signing the Rental Agreement the User confirms that he has taken over the vehicle in good condition and accepts the price and all other rental conditions.
2.3 When taking over the vehicle, the User is obliged to check the condition of the vehicle and equipment and report any defects to the Lessor.
2.4 When returning the vehicle, the Lessor is obliged to inspect the vehicle and equipment with the User and record any visible damages.
2.5 The User is obliged to return the vehicle to the agreed place within the period specified in the Rental Agreement, in the condition in which he collected it, with the same fuel level.
2.6 The loss of documents, keys, license plates or equipment is not covered by any insurance and the User is responsible for the resulting damage.

2.8 If the User returns the vehicle outside working hours, he is responsible for the vehicle until it is inspected by the Lessor's employees.
2.9 If the User returns the vehicle after the date specified in the Rental Agreement, the Lessor will perform a new calculation of the rental price.

Serious violations that void ALL insurance coverage and make the User fully liable:
Minor violations subject to proportional penalties (cleaning fees, fines) but do NOT void insurance:
3.3 The User is responsible for the rented vehicle for the entire duration of the Rental Agreement.
3.4 The User acknowledges the Lessor's right of recourse and undertakes to reimburse any amount paid to third parties.
4.1 The User must have a valid credit card as a payment guarantee.
4.2 The User agrees with the debit of the pre-authorization amount on the credit card.
4.3 The credit card holder must be present when taking over the rented vehicle.
4.4 The User is obliged to pay the basic rental price and all additional services and fees.
4.5 Accepted: credit card, electronic/debit card, or transaction payment.
4.6 The User authorizes the Lessor to charge the credit card for vehicle damage up to the excess amount.
4.7 The User agrees to have his credit card charged for repairs or costs discovered after return, provided the Lessor notifies the User in writing within 30 days of the vehicle return date. Any claims made after this period shall not be enforceable against the User.
4.8 The User undertakes to settle the invoice at the latest at the time of returning the vehicle.

5.2 Failure to comply means the User accepts liability for all consequences and full damages.
5.3 No repairs without written consent of the Lessor, except to prevent further damage.
6.1 The User must maintain the vehicle and regularly check fluid levels. Otherwise, the User is liable for resulting damage.
6.2 If technical inspection is needed during the rental, the User must notify the Lessor.
6.3 By signing, the User confirms the vehicle was collected in correct condition.
6.4 The User must immediately notify the Lessor of any vehicle warnings.
6.5 Lessor's liability for mechanical defects
The Lessor is responsible for mechanical defects and breakdowns that are not caused by the User's negligence or misuse. In such cases, the Lessor shall provide a replacement vehicle of the same or higher category at no additional cost, or offer a proportional refund for the period the vehicle was unavailable. The User shall not be liable for any towing costs arising from defects not attributable to the User.
7.1 All vehicles are insured against liability for damage caused to third parties.
What is an excess (deductible)? The excess is the maximum amount you may be liable for in the event of vehicle damage or theft. If the repair cost is less than the excess, you pay only the actual repair cost. If it exceeds the excess, you pay only up to the excess amount — the insurance covers the rest.

7.3 Police report is mandatory
Without a police report, none of the insurance options are valid.
7.4 Pre-authorisation: Start €750–€1,500 · Medium €250–€450 · Premium €150. Held max 30 days.
7.9 Insurance does NOT cover:
8.1 Free FIT — Ferry transport permission and island insurance.
8.2 Cross Border (EU) — Driving outside Croatia in EU allowed (except Greece). Green card provided.
Restricted countries:
Kosovo, Albania, North Macedonia, Greece, Romania, Bulgaria, Moldova, Ukraine, Belarus, Turkey, Estonia, Latvia, Lithuania, Russia.
8.3 Local delivery (up to 10km): €35 fee.
8.4 After hour fee for pickup/return outside working hours.
8.5 Second driver: free of charge.
8.6 Baby/child seat: €5/day, max €50. Installed by lessee.
8.7 Car replacement: same or bigger size in case of accident/breakdown.
9.1 Cross border within EU: no additional charge. Greece: €100 one-time fee. Selected non-EU countries (North Macedonia, Albania, Kosovo): €80 one-time fee.
9.2 Return the vehicle with the same fuel level or the Lessor will charge for the missing amount.
10.1 The User is responsible for all documents and equipment throughout the rental period.
10.2 Additional equipment picked up is also the User's responsibility.
10.3 Lost items: User bears the cost of compensation.
11.1 The Lessor may terminate the Agreement at any time if the User violates these terms. All claims become immediately due.
12.1 The User is liable for all traffic violations and parking fines during the rental period.
12.2 The Lessor will notify the User of any traffic violation or parking fine received and forward all related documentation.
12.3 The Lessor may provide driver information to authorities as required by law.
12.4 An administrative fee of €30 per violation will be charged for processing traffic offenses and parking fines.
12.5 The User will be notified in writing before any charge is debited from their account.
Personal data is processed for: (a) providing rental services and (b) assessing future services.
Data may be shared with control authorities, parking companies, and third parties for complaints and recovery.
The Lessee has the right to access, modify, block, or remove personal data.

Online Reservation Cancellation
Applies to reservations made via our website or booking platforms.
14.1 Online reservation is not binding until confirmed by email and signed at collection.
14.2 Cancellation is free at any time before the scheduled pickup.
14.3 No-shows (failure to pick up the vehicle without prior cancellation) are charged the full rental amount.
14.4 Online rental reservations are exempt from the 14-day cooling-off right per EU directive.
14.5 If Lessor cannot provide reserved vehicle, an equivalent or refund will be offered.
15.1 No refund is provided for unused rental days, regardless of the rental duration.
15.2 The User should notify the Lessor at least 24 hours in advance if returning the vehicle early.
15.3 Minimum rental period applies. Early return does not reduce the User's liability for any damage that occurred during the rental.
16.1 Neither party is liable for failure due to causes beyond reasonable control (natural disasters, pandemic, war, strikes, etc.).
16.2 The affected party must notify the other party and mitigate effects.
16.3 Full refund of prepaid amounts if Lessor cannot provide the vehicle due to force majeure.
17.1 Governed by the laws of the Republic of Croatia, including the Civil Obligations Act (OG 35/05), the Consumer Protection Act (OG 41/14, 110/15, 14/19), and EU Regulation 2016/679 (GDPR).
17.2 Disputes first subject to amicable resolution.
17.3 Jurisdiction: competent courts in Split, Croatia.
17.4 EU consumers may use the ODR platform: ec.europa.eu/consumers/odr
17.5 Terms may be amended. The version at time of signing applies.
